Terms & Conditions of Club Mecca

Mecca Club Prague operated by Platinum Capital, s.r.o. (VAT ID CZ24791482), (“Mecca Club”) provides ticketing, table reservation and goods sale services, including the sale of tables, sale and distribution of tickets and sale and distribution of other material goods such as merchandising. In providing these services, Mecca Club owns and operates www.mecca.cz (the “Site”).

 

Please read these Terms and Conditions carefully before purchasing any of our goods and services. By purchasing any goods and services from Mecca Club, you agree to be bound by these Terms and Conditions.

These Terms and Conditions relate both to the sale of goods and services and attendance at events. These Terms and Conditions apply to both the original purchaser and any subsequent holders (“you”).

 

Variation to Terms and Conditions

Mecca Club may vary these Terms and Conditions at any time by updating them. Any variations will only apply to goods and services purchases made after these Terms and Conditions have been updated.

 

General Terms and Conditions

Mecca Club acts as the Seller in the sale of all goods, table reservations and tickets. All claims in connection with tickets, table reservations or goods sell are subject to these Terms and Conditions, Mecca Club otherwise has no liability to you.

 

Refunds, exchanges and replacements

  1. Mecca Club will only offer a refund or exchange of a ticket or table reservation if an event is cancelled or rescheduled or significantly relocated by the Seller (and you cannot or do not wish to attend the rescheduled or relocated event). You must apply for a refund within a reasonable time. Mecca Club does not offer refunds or exchanges as a result of a change in your personal circumstances. The price of the ticket or table reservation is equal to the cancellation fee.

  2. Mecca Club only offer a refund or exchange of good if the item is damager or not functional as claimed in the product description or to the extent otherwise required by Consumer rights given by the Civil Code of Czech Republic.

  3. If an event is cancelled or rescheduled, all liability is limited to the amount for which the ticket was purchased (including any fees or charges). Proof of purchase may be required for any refund or exchange. Mecca Club will not be liable for any other losses incurred by you as a result of the cancellation or rescheduling of an event, including any travel and accommodation expenses.

  4. Mecca Club will only replace lost, stolen, damaged or destroyed tickets if the authenticity of the ticket can be verified, including proof of purchase, and if you give reasonable notice before the event. Mecca Club may charge a reasonable fee for the replacement of tickets.

Variations to performances or events

  1. Mecca Club reserves the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements (including ticket categories) and audience capacity.

 

Conditions of entry

  1. Admission to an event is subject to these Terms:

    • You may be denied entry into, or removed from, an event where Mecca Club has reasonable grounds to do so, including if you breach these Terms and Conditions, or you are intoxicated, under  the influence of illicit drugs, inappropriately attired or adversely affecting the enjoyment of the event by others.

    • If you arrive late, you may not be admitted until a suitable break in the event.

    • You may not be permitted to take into the event, or use, cameras or other photographic or recording equipment (including mobile phones).

    • You are not permitted to take into the event any food and alcoholic and not alcoholic beverages.

    • You are not permitted to take into the event any weapons, sharp objects, pepper sprays, tasers and any other objects that may be dangerous to other visitors or staff of the club.

    • You may be required to submit to a search of your person and/or possessions before entering the event.

 

Authenticity and validity of tickets and reservations

  1. Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from Mecca Club or other authorised points of sale.

  2. Entry to your table reservation may be refused if you are not able to prove your name by a legal ID issued by the country of your origin or residence. 

 

Resale of tickets & scalping

  1. Tickets and vouchers for table reservations may not, without the prior written consent of Mecca Club be resold or offered for resale at a premium (including via on-line auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket or voucher is sold or used in breach of this condition, the ticket may be cancelled without a refund and the holder may be refused admission. Mecca Club will take all reasonable steps to notify you of Mecca Club’s intention to cancel the ticket (or reservation, or vouhcer) or to render it invalid within a reasonable time before cancelling it or rendering it invalid.


SCALPING WARNING: The resale of tickets and vouchers in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

 

Collection and delivery of tickets and vouchers

  1. You must allow adequate time for collection or delivery of tickets. Methods of collection and/or delivery will be available when choosing your collection/delivery details. In the interests of minimising ticket scalping, Mecca Club may change your delivery method to "venue collect" at its discretion.

  2. Where concessions are applicable, suitable and valid identification must be provided for collection of tickets and at the event.

 

Limitations on number of tickets purchased

  1. When purchasing tickets or table reservation you may be limited to a specified number of tickets or tables. If you exceed the stated ticket limit, you may have any or all of your orders and tickets cancelled without notice by Mecca Club at its discretion. This includes orders associated with the same name, e-mail address, billing address, credit card number or other information. Ticket and table limits apply to ensure fair access to tickets for fans, and as a measure to minimise ticket scalping.

 

Errors

  1. While Mecca Club takes all reasonable care to ensure that tickets and tables are correctly priced and only available for sale when intended, sometimes errors may occur. Mecca Club may cancel an order made as a result of any such error, although in the case of a pricing error Mecca Club will endeavour to contact you to give you the option of purchasing the ticket at the correct price.

 

General

The term “including” when used in these Terms and Conditions is not a term of limitation.

 

Protection of personal data

  1. The protection of your personal data as a natural person is provided by Act No. 101/2000 Coll., On the Protection of Personal Data, as amended.

  2. You agree to process these personal data: name and surname, home address, identification number, tax identification number, e-mail address, telephone number. (collectively referred to as "personal data").

  3. You consent to the processing of personal data by the Mecca Club for the purpose of implementing the rights and obligations of the Purchase Agreement and for the purpose of maintaining the User Account and for the purpose of sending information and business communications. Consent to the processing of personal data in its entirety under this Article is not a condition that would in itself make it impossible to conclude a sales contract.

  4. You acknowledge that you are required to report your personal information (when registering, in your user account, when ordering from the web interface of the store) correctly and truthfully and that you are obliged to inform the seller of any change in your personal information without undue delay.

  5. By processing your personal data, the seller may assign a third person as processor. In addition to persons transporting goods, personal data will not be passed on to third parties without your prior consent.

  6. Personal data will be processed indefinitely. Personal data will be processed in electronic form in an automated manner or in a printed form in a non-automated manner.

  7. You acknowledge that the provided personal data is accurate and that it has been advised that this is a voluntary provision of personal information.

  8. If you ask the Mecca Club for information on the processing of your personal data, the Mecca Club is required to provide you with this information. The Mecca Club is entitled to request a reasonable reimbursement not to exceed the costs necessary to provide information for the provision of information under the preceding sentence.

  9. Should you believe that the Mecca Club or processor carries out the processing of your personal data contrary to the protection of your private and personal life or in violation of the law, especially if personal data are inaccurate with regard to the purpose of their processing, you may:

    • ask Mecca club or processor for explanations,

    • require the Mecca club or processor to remove the resulting situation.

 

Sending business messages and storing cookies

  1. You hereby consent to the sending of information relating to the Mecca goods, services or club to your e-mail address, and you further agree to the sending of business communications to your e-mail address.

  2. You further agree to store so-called cookies on your computer. If you can make a purchase on a website and fulfill your obligations under the purchase agreement without storing cookies on your computer, you can withdraw consent under the preceding sentence at any time.
